Get a separate quote for each part of the buyout
Ask for estimates covering valuation, legal work, title or registration and financing. Check whether each includes tax and third-party charges, who pays it and when it falls due.
Keep sale-only expenses, such as staging or agent fees, out of the buyout budget unless you have expressly agreed otherwise. The buyout versus selling comparison shows why combining the two budgets can distort the result.
Keep loan charges separate from the equity payment
Use the lender’s written estimate to check the proposed loan and its fees. For US mortgage applications, the Loan Estimate distinguishes the loan terms and closing charges. The interest rate in the Equity.me calculator is an illustration, not a quote.
A fee deducted from shared equity should not also be added as a funded cost without accounting for the first deduction. In the dossier, Costs records payments already made; an unpaid obligation belongs among the debts.
Check the tax rules for your type of ownership transfer
Tax treatment depends on the property’s location, ownership and transaction. A sale to a third party, a transfer between spouses and an unmarried partner buyout should not be assumed to have the same treatment.
For US federal income tax, qualifying transfers between spouses or former spouses incident to divorce generally do not recognise gain or loss at transfer. Conditions and exceptions apply. This is not a blanket exemption for every buyout or for unmarried co-owners.
For a qualifying transfer, the recipient generally takes over the transferor’s adjusted tax basis. That can affect a later sale. State or local transfer charges require a separate check.
Do not calculate capital gains tax from the equity balance
Mortgage payoff changes the cash remaining, while a gain calculation uses the relevant sale proceeds and adjusted tax basis. They are different calculations. Keep the purchase, improvement and transfer records your tax adviser needs.
Equity.me does not calculate tax or determine an exemption. Add the confirmed tax treatment to your transaction budget before finalising the steps to complete a house buyout.
